Terms of Service

Please read these terms carefully before using our platform. They are a binding agreement between you and Hot Housekeepers Houston.

1. Introduction

Welcome to Hot Housekeepers Houston (“we,” “our,” “us”). These Terms of Service (“Terms”) govern your use of our website, booking platform, and related services (together, the “Platform”). By creating an account, sending a booking request, or otherwise using the Platform, you agree to these Terms, our Code of Conduct, and our Privacy Policy. If you do not agree, you must not use the Platform.

If you are a housekeeper, the Housekeeper Policies also apply to you. Where these Terms and the Housekeeper Policies conflict on a matter specific to housekeepers, the Housekeeper Policies control.

2. What We Are

Hot Housekeepers Houston is a platform that connects clients with independent housekeepers. We provide the website, booking tools, identity verification, messaging, and payment processing. We do not ourselves perform housekeeping services.

  • Every housekeeper on the Platform is an independent contractor. Housekeepers are not our employees, agents, partners, or joint venturers. They decide which bookings to accept, when and where they work, and how they perform the work.
  • When you book, you are engaging the housekeeper you selected to perform the service. We facilitate that engagement and handle payment on the housekeeper’s behalf.
  • Nothing on the Platform, including words such as “our housekeepers,” “our team,” or “staff,” creates an employment or agency relationship between us and any housekeeper.

3. The Services

Housekeepers on the Platform provide residential housekeeping performed in a uniform or costume selected by the client, depending on the selected package, housekeeper availability, and local law compliance. Housekeepers remain fully clothed at all times, all services are strictly non-contact, and no escort, companionship, massage, or sexual service is offered or available on the Platform at any price or under any arrangement. Requesting one ends the appointment immediately without a refund and may result in a permanent ban.

Services consist of light housekeeping tasks such as dusting, surface cleaning, and tidying up. Deep cleaning, carpet shampooing, work at height, and handling of hazardous materials or biohazards are not offered. Each housekeeper sets her own hourly rate within the range shown for each style, and any minimum booking length, travel fee, or add-on is shown in your total before you pay.

4. Eligibility and Identity Verification

You must be at least 18 years old to use the Platform. By using it you represent and warrant that you meet this requirement.

Before a housekeeper can accept your first booking request, you must complete identity verification through our verification provider, Stripe. This involves photographing a government-issued ID and taking a selfie that is matched to it. Verification is required once per client, not per booking. We receive the result of the check and the name printed on the verified document; the images and the biometric comparison are handled by Stripe under its own privacy terms, as described in our Privacy Policy. A booking cannot proceed to acceptance or payment until verification has cleared, and we may decline service to anyone whose verification fails or who we reasonably believe is not who they claim to be.

Verification confirms who booked. To confirm who answers the door, we show your housekeeper the name on your verified ID once a booking is confirmed, and she may ask to see that ID when she arrives. She will not photograph or copy it. If the person present is not the verified client, or declines to show ID, she may leave without starting the service, and that is treated as a failure to provide access under Section 6.

5. Accounts

An account is required to send a booking request or to apply as a housekeeper. You agree to give accurate, current information and to keep it updated, to keep your login credentials confidential, and to tell us promptly if you believe your account has been used without your permission. You are responsible for all activity under your account. You may hold one client account, and we may suspend or close accounts that are shared, duplicated, or used to evade a ban.

6. Booking and Payment

  • Booking: All bookings must be made through our website or by contacting our customer service.
  • Payment: Your booking is a request until a housekeeper accepts it. Once accepted, payment is taken in full to confirm the booking — there is no deposit and no separate balance due later. Your booking is not confirmed until payment is complete. We accept various payment methods, including credit cards and online payment platforms via our secured Stripe Checkout.
  • Card holds: Where the appointment is within five days of confirmation, we place an authorization hold on your card for the full amount at confirmation and capture the payment when the housekeeper marks the service complete. If the service has taken place and the hold is about to expire before completion is recorded, we may capture it at that point. For appointments further out, your card is charged at confirmation. In either case the amount is the total shown to you before you paid.
  • Cancellation by you: Notice is measured from the scheduled start of the service. Cancel 48 hours or more before and you receive a full refund (an uncaptured hold is simply released). Cancel between 24 and 48 hours before and 50% of the booking total is retained. Cancel less than 24 hours before, or fail to provide access at the scheduled time, and the booking is non-refundable. If you dispute a claim that access was not provided, we will review it and may refund some or all of the amount retained.
  • Cancellation by us or the housekeeper: If the housekeeper cancels, or we cancel for any reason other than your breach of these Terms, you receive a full refund regardless of timing.
  • Eligible Refunds: Eligible refunds will be processed within 5-7 business days.
  • All payment goes through the Platform. You may not pay a housekeeper directly, in cash or otherwise, for a service booked here, and you may not book a housekeeper you met through the Platform outside it. Doing so removes every protection described on this page, for both of you, and is grounds for closing your account. The one exception is a tip: a cash tip you choose to hand your housekeeper is hers to keep, and we take no share of it.

7. Your Home

A housekeeper works alone in your home. You agree to:

  • Provide a safe, sanitary working environment with reasonable temperature and lighting, and disclose in advance any hazard, including aggressive animals, structural problems, mold, pests, or biohazards.
  • Keep pets secured, and tell us at booking whether pets and other people will be present. Only you (the verified client) and other consenting adults may be present during the service, and you must be there to receive her — see Section 4 on the ID check at the door. You must be reachable throughout.
  • Secure cash, jewelry, firearms, medications, and fragile or high-value items before the appointment.
  • Tell your housekeeper before she starts about any camera or recording device in the areas where she will be working. You may not photograph, film, or record a housekeeper without her prior written consent, and you may not publish any image or recording of her under any circumstances.

A housekeeper may pause or end a service, without refund, if the environment is unsafe or if these requirements are not met.

8. Conduct

  • Client conduct: You must treat housekeepers with respect at all times and follow our Code of Conduct, which sets out behavioral expectations, boundaries, and safety rules. Harassment, abuse, physical contact, propositions, or any inappropriate behavior may result in immediate termination of the service without a refund, a permanent ban, and, where warranted, a report to law enforcement.
  • Housekeeper conduct: Housekeepers agree, under the Housekeeper Policies, to perform their work with respect, discretion, and professionalism, and to offer nothing outside the booked service.

9. Communication

All communication with your housekeeper before, during, and after a booking must go through the message thread on your booking. That thread is visible to both of you and can be reviewed by us in the circumstances described in our Privacy Policy. You may not solicit a housekeeper’s personal contact details, and you may not contact her outside the Platform.

By creating an account you consent to receive transactional email from us about your account and bookings. We do not send text messages unless you have separately opted in, and you can opt out of any marketing email at any time.

10. Reviews, Messages, and Content

You may leave a review after a completed booking. Reviews must be truthful, must relate to your own experience of that booking, and must not contain personal information about anyone or content that is abusive, discriminatory, or unlawful. Reviews are held for a period before publication and we may decline to publish or may remove a review at our discretion.

You grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce reviews and other content you submit through the Platform for the purpose of operating and promoting the Platform. We may remove any content that breaches these Terms.

11. Problems With a Service

If something goes wrong, tell us as soon as possible and in any case within 48 hours of the appointment, using Something wrong with this job? on your booking page or by emailing support@hothousekeepershouston.com. Include photos where relevant. We will review what happened, work with you and the housekeeper on a resolution, and may issue a partial or full refund where we consider it warranted. Claims reported after 48 hours may be declined.

Damage to property: Housekeepers are independent contractors and are responsible for their own work. Neither we nor a housekeeper is liable for damage to fragile, unsecured, pre-damaged, or high-value items, or for damage that results from a hazard you did not disclose, unless caused by intentional misconduct or clear negligence. Please store such items safely before your appointment.

12. Privacy

How we collect, use, and share personal information, including what is shared with your housekeeper and when, is described in our Privacy Policy, which forms part of these Terms.

13. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Housekeepers on the Platform pass a criminal background check run by a consumer reporting agency, and clients pass identity verification. These checks reduce risk; they do not eliminate it, and we do not guarantee the accuracy, completeness, or currency of any check, or the conduct, quality of work, or suitability of any user. You use the Platform and engage with other users at your own judgment.

We do not guarantee that the Platform will be uninterrupted or error-free, or that any particular housekeeper, date, or time will be available.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE PLATFORM OR ANY SERVICE BOOKED THROUGH IT.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM OR A SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR THE BOOKING GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100) IF THE CLAIM DOES NOT RELATE TO A SPECIFIC BOOKING.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our own gross negligence or willful misconduct.

15. Indemnification

You agree to indemnify and hold harmless Hot Housekeepers Houston, its owners, and its personnel from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, your violation of any law or the rights of any person, or your conduct toward a housekeeper or during a service.

16. Dispute Resolution and Arbitration

Please read this section carefully. It affects your legal rights.

  • Talk to us first. Before starting any formal proceeding, you agree to email support@hothousekeepershouston.com describing the dispute, and to give us 30 days to try to resolve it with you.
  • Binding arbitration. Any dispute or claim arising out of or relating to these Terms, the Platform, or any service booked through it that is not resolved informally will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, before a single neutral arbitrator, in Houston, Texas. The Federal Arbitration Act governs this section. The arbitrator’s decision is final and binding and may be entered as a judgment in any court of competent jurisdiction.
  • Small claims. Either party may instead bring an individual claim in small claims court in Harris County, Texas, if it qualifies.
  • Class action and jury trial waiver. You and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. To the extent a claim proceeds in court rather than arbitration, each party waives any right to a jury trial.
  • Opt-out. You may opt out of this arbitration agreement by emailing support@hothousekeepershouston.com with your name and the email on your account within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.
  • Time limit. Any claim must be brought within two years of the date it arose, or the shortest longer period that applicable law requires.
  • Fees. Arbitration fees are allocated under the AAA Consumer Arbitration Rules. Each party otherwise bears its own attorneys’ fees unless the arbitrator awards them under applicable law.

17. Termination

We may suspend or close your account, and cancel any pending booking, at any time for a breach of these Terms or the Code of Conduct, for a safety concern, or for any other lawful reason. No refund is given where termination results from your misconduct or breach. You may close your account at any time by contacting us; bookings already confirmed remain subject to the cancellation terms above. Sections 10 and 13 through 16 survive termination.

18. General

  • Force majeure: Neither party is liable for delay or failure to perform caused by events beyond its reasonable control, including acts of God, government restrictions, natural disasters, strikes, or unforeseeable operational issues.
  • Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect. If the class action waiver in Section 16 is found unenforceable as to a particular claim, that claim proceeds in court, not in arbitration.
  • Modifications: We may modify these Terms. We will post the updated Terms on our website and, for material changes, notify you by email or a notice on the Platform before they take effect. Your continued use of the Platform after that date constitutes acceptance. Changes do not apply retroactively to a booking already confirmed.
  • Governing law: These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and by the Federal Arbitration Act as to Section 16.
  • Entire agreement: These Terms, together with the Code of Conduct, the Privacy Policy, and (for housekeepers) the Housekeeper Policies, are the entire agreement between you and us about the Platform.
  • No waiver; assignment: Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.

19. Service Area

Services are provided within the greater Houston metropolitan area. Each housekeeper sets the areas she travels to, and you will only be shown housekeepers who cover your ZIP code.

A travel fee may apply, based on the distance between the housekeeper and your address: no fee under 12 miles, $25 from 12 to 25 miles, and $50 beyond 25 miles. Any travel fee is calculated automatically and shown in your total before you pay.

20. Intellectual Property

All content, trademarks, and materials on our website remain the property of Hot Housekeepers Houston or its licensors. You may not reproduce, distribute, scrape, or use our content, including housekeeper profile photographs, without written permission.
